If you do not agree to these Terms, please do not use our Services. These Terms apply to all visitors, users, and applicants who access or use the Services.

Lending Marketplace

ASBCLF operates as a business lending marketplace that connects small business owners and entrepreneurs with a network of third-party lenders and financing providers. We are not a lender, bank, or financial institution. We do not make credit decisions or fund loans directly.

No Guarantee of Financing

Submitting an application does not guarantee that you will receive a financing offer. Approval decisions are made solely by individual lenders based on their own underwriting criteria. ASBCLF makes no representations or guarantees regarding loan approval, interest rates, terms, or availability of funding.

Advisory Services

Our dedicated Business Finance Advisors provide guidance throughout the lending process. This guidance is informational and does not constitute financial, legal, or investment advice. We recommend consulting with qualified financial and legal professionals before making major financial decisions.

To use our Services, you must: (a) be at least 18 years of age; (b) be a legal resident or citizen of the United States or an authorized business entity formed under U.S. law; (c) have authority to bind your business to these Terms; (d) provide accurate, complete, and truthful information in your application; and (e) not be prohibited from using our Services under applicable law.

Accuracy of Information

You represent and warrant that all information you provide in connection with your application is true, accurate, current, and complete. Providing false, misleading, or fraudulent information may result in immediate termination of your application and may constitute a violation of applicable laws.

Authorization to Share

By submitting an application, you expressly authorize ASBCLF to share your personal, business, and financial information with lenders in our network, credit bureaus, and other third-party service providers as necessary to process your application and provide our Services.

Credit Inquiries

Our initial application process uses a soft credit inquiry that does not affect your credit score. If you choose to proceed with a specific lender's offer, that lender may perform a hard credit inquiry, which may impact your credit score. You will be notified before any hard pull occurs.

No Fee to Applicants

ASBCLF does not charge applicants any fee to submit an application or use our matching services. Our platform is free to borrowers.

Lender Compensation

ASBCLF may receive compensation from lenders and financing partners in our network when a loan is successfully funded. This compensation does not affect the rates or terms offered to you. We are committed to presenting the most suitable options for your situation regardless of compensation arrangements.

Independent Parties

Lenders in our network are independent third parties, not agents or employees of ASBCLF. ASBCLF is not responsible for the actions, decisions, products, or services of any lender. Any loan agreement you enter into is solely between you and the applicable lender.

Review Loan Documents

You are solely responsible for reviewing and understanding all terms, conditions, fees, and obligations in any loan agreement before signing. We strongly recommend reviewing all documents carefully and seeking independent legal or financial advice if needed.

You agree not to use our Services to: (a) provide false or misleading information; (b) engage in fraudulent activity or attempt to obtain financing through deceptive means; (c) violate any applicable federal, state, or local laws or regulations; (d) infringe upon the intellectual property rights of ASBCLF or any third party; (e) transmit any harmful, offensive, or disruptive content; (f) attempt to reverse-engineer, scrape, or copy our platform; or (g) use our Services for any illegal or unauthorized purpose.

All content on the ASBCLF website and platform, including text, graphics, logos, images, and software, is the property of ASBCLF or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written consent.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. ASBCLF DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE FULLEST EXTENT PERMITTED BY LAW, ASBCLF AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED $100.

You agree to indemnify, defend, and hold harmless ASBCLF and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any third-party rights.

These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Services shall be resolved through binding arbitration in Clark County, Nevada, in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website with a revised "Last Updated" date. Your continued use of the Services after such changes constitutes your acceptance of the updated Terms.
